How much compensation can I claim?
As of October 2016, the maximum amount you can claim for Non-Economic Loss (such as medical bills or compensation for grief) in New South Wales is $521,000. The Consumer Price Index (CPI) amount is added to this value every year.
As of October 2016, the weekly wage loss compensation claim was capped at $4,777. The CPI amount is also added to this amount each year.
If your claim is successful, the amount of compensation you will get will be calculated based on your specific circumstances (for example, how severely you might have been disabled).
Economic losses, such as missed wages due to time off work, must be supported by proof. This could be in the form of receipts, pay stubs, or tax returns, and you must also show that you are owed money.
What if my claim is small?
It is extremely difficult to estimate the extent of a claim at the time of injury. Within three months of the date of injury, a claim form should be delivered to the CTP insurance.
If the claim form is not returned within three months, your compensation claim may get complicated. The three-month deadline is crucial.
Applying for reimbursement of expenses or lost wages is a simple process. If this is your situation, you must submit an Accident Notification Form to the State Insurance Regulatory Authority (SIRA) within 28 days of the incident. We can also assist you with this at Gajic Lawyers.
