Motor Vehicle Accident – How We Help
Have You Suffered Injury in a Motor Vehicle Accident?
If you were involved in an incident and you were a driver or a passenger, on public transport or in a private motor vehicle, or a pedestrian, you may be entitled to claim compensation.
The law also allows for “no-fault” claims. If you were at fault and have suffered a catastrophic injury, in some cases you may also be able to make a claim.
Every driver in NSW is covered by Compulsory Third Party (CTP) insurance, which makes compensation possible in cases like yours.
If you have suffered because of an incident involving a motor vehicle, we can help you claim the compensation you are entitled to.

In New South Wales, the law that covers incidents involving motor vehicles is the Motor Accidents Acts (1988) and the organization that regulates this law is the State Insurance Regulatory Authority (SIRA).
The SIRA has been running since 1989 and manages all the legal processes relating to incidents involving any kind of motor vehicle, including:
- Cars, Trucks and Motorcycles;
- Pedestrians;
- Public Transport Vehicles (buses, trains, ferries, trams)
- Boats and other marine vehicles.
*The law in New South Wales on motor vehicle accident claims has recently changed. The new CTP scheme started on 1 December 2017 and more information on this will be posted on this website shortly. – 20022018

How much Compensation can I Claim?
In New South Wales, the most you can claim for Non-Economic Loss (for example, medical expenses, or compensation for distress) as at October 2016 is $521,000. This figure is annually increased by the Consumer Price Index (CPI) amount.
Weekly wage loss compensation claim is capped at $4,777 as at October 2016. This amount is also annually increased by the CPI amount.
If your claim is successful, the amount of compensation you are awarded will be worked out according to your circumstances (for example, how severely you might have been disabled).
Economic Loss – such as lost earnings, because of time off work – needs to be shown through evidence. This could take the form of receipts, payslips or tax returns, and you also have to show that you need to be repaid.
What if my claim is only small?
It is very difficult to determine at the time of injury the size of the claim. It is recommended that a claim form be sent to the CTP insurer within the 3 months of the date of injury.
If the claim form is not sent in 3 months, there could be complications in your claim for compensation being pursued. The 3-month time limit is critical.
There is a simple process for applying for repayment of expenses or lost earnings. If your case is like this, then you should send an Accident Notification Form to the State Insurance Regulatory Authority (SIRA) within 28 days of the day the incident happened. At Gajic Lawyers, we can help you with this too.
