Workers’ Compensation Lawyers NSW
Have you suffered because of an incident that happened at work?
Most employees in New South Wales have insurance cover handled by their employer. In the event an employee sustains an injury while working, they may be entitled to claim compensation. This is covered by Workers Compensation insurance and managed by the WorkCover Authority of New South Wales.
Workers Compensation Claims are usually easy to settle and do not need legal advice/assistance. But if you are in a more complex situation or one that forces you to be out of work for a long period of time, our NSW workers’ compensation lawyers are here to help you!
We can help and advise you immediately after the injury to assist you in receiving all your entitlements.
Therefore, if you have suffered as a result of an injury at work and you are having trouble with your Workers Compensation Claims, call Gajic Lawyers for a chat on (02) 9890 5885.
The WorkCover Authority is a government organisation that handles workers’ compensation cases in New South Wales.
Your employer will almost always have a Workers Compensation insurance policy, regardless of the type of work you do. This insurance protects you from a variety of risks, including:
An injury at work has left you physically disabled.
- Long-term illness as a result of your job’s nature and conditions
- Repetitive Strain Injury (RSI)
- Mental illness (including stress)
- Hearing loss is a common problem.
- Injuries sustained while travelling for work
Insurers can pay Workers Compensation in three different ways: as a lump sum, weekly benefits, or medical expenditures.
Lump-Sum Compensation
If the injury has left you permanently disabled, you may be able to file a claim for lump-sum compensation. This claim is based on the severity of your injuries and how they affect your capacity to work. WorkCover-trained medical specialists provide permanent disability assessments.
Weekly Benefits Compensation
The following factors will influence a claim for weekly benefits:
- Before your injury, what was your average weekly income?
- Your ability to work following your injury, as well as your earnings
- You’ve been completely incapacitated from work for a period of time.
Medical Expenses Compensation
Medical expenses are only recoverable if they are reasonable and necessary in light of the law and your injury. Treatment and surgical costs may be included in these claims, which must be pre-approved by the insurance company. Medical expenditures can only be claimed and recovered within a certain amount of time.

Can I claim compensation for injuries from a car accident on my way to work?
You may be eligible to file a claim for injuries received during work breaks as well as some travel related to your job. There must be a direct and meaningful link between your job and the incident or accident that caused your injury.
If the incident occurred while you were travelling, you may be eligible to claim compensation:
- as a pedestrian
- in a motor vehicle (as a driver or passenger)
- on public transportation
Our motor vehicle accident team can help you if your accident occurred while you were driving to or from work and there was no significant link between your employment and the accident. For additional information about motor vehicle claims, see here.
What is WIRO and how does it affect my claim?
As part of its reforms of the state’s workers compensation system, the NSW government established the WorkCover Independent Review Office (WIRO) in 2012. In Workers Compensation Claims, WIRO regulates and pays solicitors’ fees and medical reports.
For more information about WIRO, go here.
What about emergency workers' compensation? (police, ambulance, fire, etc.)
The New South Wales government made modifications to the Workers Compensation System in June 2012. All new and existing Workers Compensation Claims are affected by these changes, with the exception of claims for:
- People who have filed a claim under the Workers’ Compensation (Dust Diseases) Act of 1942 for a dust disease
- Officers of the law, paramedics, and firefighters are all involved.
- Volunteer bush firefighters and emergency service personnel (Rural Fire Service, Surf Life Savers, SES volunteers)
- Employees who have been harmed while working in or near a coal mine
Workers in these groups are not covered by the Workers Compensation Legislation Amendment Act (2012) and are assessed under the Workers Compensation Act (1987).
